WishesMadeVisual is a personalized video greeting service based in Sweden. We offer customized video greetings from Africa, which are delivered to customers via email as a downloadable file.

2. Placing an Order 
To place an order, customers must visit our website and provide us with the necessary information to create their personalized video greeting. Payment is made through our website before the order is processed.

3. Delivery
We strive to deliver your video greeting in a timely and professional manner. However, we do not guarantee specific delivery times or dates. We are not liable for any delays or issues that arise during delivery, including technical difficulties or incorrect email addresses. We are also not responsible for any content that may be lost or deleted due to customer error.

4. Refunds and Compensation 
We do not offer refunds for personalized video greetings that have already been delivered. Additionally, we do not compensate for any errors or issues that may arise during the creation or delivery process, including but not limited to incorrect pronunciation or incorrect dance moves by the performers. We also do not compensate for any discrepancies in the length of the video, as this can vary based on the content and creative direction.

5. Intellectual Property 
All content created and provided by WishesMadeVisual, including but not limited to video greetings, graphics, and text, are the property of WishesMadeVisual and protected by international copyright laws. Customers may not use, reproduce, or distribute any of our content without prior written consent.

6. Privacy Policy 
We are committed to protecting our customers' privacy and personal information. We do not share any personal information with third parties, except as required by law or as necessary to fulfill our services.

7. Limitation of Liability 
WishesMadeVisual shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services or any content provided on our website. Customers agree to indemnify and hold harmless WishesMadeVisual and its officers, employees, and affiliates from any claims or damages resulting from their use of our services.

8. Governing Law and Jurisdiction 
These terms and conditions shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts of Sweden.

9. Nature of the Product

WishesMadeVisual provides personalized audiovisual productions featuring creative performances, choreography, music, and customized visual content.

Each purchase includes the production and delivery of a personalized video together with a license granting the customer rights to use, reproduce, distribute, publish, and commercially exploit the delivered video.

10. Copyright Protection

Video productions supplied by WishesMadeVisual may contain original creative elements protected by applicable copyright and intellectual property laws.

Such elements may include audiovisual compositions, choreography, creative performances, editing, and other original artistic contributions.

All underlying intellectual property rights remain with WishesMadeVisual or their respective rights holders unless expressly transferred in writing.

11. Grant of Commercial License

Upon full payment and delivery of the completed video, WishesMadeVisual grants the customer a worldwide, perpetual, non-exclusive, royalty-free commercial license to the delivered video, subject to these Terms & Conditions.

This license permits the customer to:

  • Reproduce, download, store, and distribute the video.
  • Publish the video on social media, websites, and digital platforms.
  • Use the video in commercial advertisements and marketing campaigns.
  • Monetize the video through digital platforms.
  • Edit, adapt, crop, or combine the video with other content.
  • Display or broadcast the video publicly.
  • Sell or otherwise commercially distribute copies of the completed video.
  • Sublicense the completed video to third parties.

The license applies to the completed video as delivered and does not transfer ownership of any underlying choreography, music, performances, or other separately protected elements.

12. Rights and Restrictions

The customer may exercise the licensed rights without additional licensing fees payable to WishesMadeVisual.

The customer must not use the video in a manner that violates applicable law, infringes third-party rights, or falsely implies endorsement by the performers or WishesMadeVisual.

Any use of third-party materials remains subject to applicable rights and restrictions.

13. Customer-Provided Content

The customer confirms that they have the necessary rights or permissions to provide any photographs, names, messages, or other materials submitted for inclusion in the video.

The customer grants WishesMadeVisual permission to use these materials solely as necessary to produce and deliver the ordered video.

14. Delivery and Licensing

The commercial license is included in the purchase price and becomes effective upon full payment and delivery of the completed video.

No separate licensing purchase is required.
